SHORT TERM RENTAL AGREEMENT FOR SANDBANKS LODGE
This Short Term Rental Agreement (The “Agreement”) is made by and between Wimbledon Real Estates Ltd (The “Homeowner”) and __________ (The “Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
- Property. Sandbanks Lodge property is located at Bahamas Sound 11, south of George Town, Great Exuma, Bahamas
- Caretaker: Josh Joyce is our Property Management company and is referred to as The “Caretaker” in this agreement. He is responsible for the care of the property and not the care of the guests
- Rental Party: The rental party shall consist of no more than 18 Guests, consisting of _____ Adults and ______ Children
- Term of the Lease. The lease begins at 4:00 p.m. _______ (The “Check-in Date”) and ends at 10:00 a.m. on _______ (The “Checkout Date”)
- Effective Date: The offer to rent and the terms of this agreement are not in effect until both this Agreement and the first payment are received by the Homeowner.
- Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Exhibit A must be signed and dated.
- Access: Guest shall allow Homeowner and/or Caretaker or Agents for The Caretaker access to the property for purposes of repair and inspection. Homeowner and The Caretaker shall exercise this right of access in a reasonable manner.

Rental Rate and Fees: Nightly Rates are not guaranteed until the agreement is signed by the Guest and accepted by the Homeowner.

Payment Terms
- There will be three payments, unless otherwise agreed.
- All payments are to be made through this site.
- The Booking Deposit will be 1/3 of The Total Due. It will be made when booking The Property.
- The Second Payment will be 1/3 of The Total Due. It will be made sixty (60) days prior to The Check-in Date.
- The Final Payment will be 1/3 of The Total Due and The Refundable Security Deposit. It will be made thirty days (30) days prior to The Check-in Date.
- If any of the payments are not received when they fall due, it creates the presumption of a cancellation, renders the Property available for rent and all payments may be forfeited. At the Homeowner’s discretion, the Property may be re-rented. If a new rental is accepted, any payments may be returned to the Guest, less any fees or rent discounts.
- The refundable Security Deposit will be returned following the completion of the departure cleaning and inspection. The Homeowner will contact the Guest if there are any charges that need to be deducted from the security deposit for any unusual cleaning or for any repairs for damages which are beyond normal wear and tear. This usually happens within 2-5 business days and the Security Deposit is returned within 2-7 business days.

Cancellation Policy: If Guest wishes to cancel his/her reservation, refunds will be handled as follows:
- The default position is that:
- all payments made by The Guest will be retained by The Homeowner, and
- The Guest will be liable for any unpaid sums.
- The Homeowner will re-advertise The Property and if successfully re-leased he will return the payments to The Guest (less admin charges and any reductions in rental income from the new guests).
- Hurricane: In the event that a Hurricane warning is in effect for Great Exuma island within 48 hours of the Check-in Date and the path is likely to impact the Guest’s arrival or stay, the Homeowner will work with Guest to find a mutually convenient date to reschedule the stay or refund the Guest’s rent less any applicable credit card fees. Refund of Guest's rent will be determined by the amount of unused nights stayed in the agreement.
- Insurance: Guest acknowledges that he/she has been advised by the Homeowner to purchase adequate traveller insurance - including but not limited to trip interruption, trip cancelation, medical, etc. Exuma has a medical clinic on the west side of George Town that has limited medical capabilities. Serious medical needs may require airlift to the U.S. Flights into Exuma can be limited and delays can happen causing a missed connection to Exuma
- Minimum Age: Guest shall be at least twenty-five (25) years old at the Check-in Date to rent this Property. Misrepresentation shall void this contract and all monies paid shall be forfeited. The Guest must accompany the Rental Party if it contains individuals that are less than 25 years old.
- Liabilities: The Guest’s person and personal property shall be at the risk of guest. The Homeowner and Agents are not liable for personal items left behind, lost, or stolen.

Property:
- Extras; Televisions, media players, internet service, Bluetooth speaker, telephone, etc., herein called “Extras”, are available for use at the Property at no extra charge as a convenience for the Guest and the Rental Party’s use. In the event of a malfunction or breakdown of Extras, the Owner or Agents will have the Extra repaired as quickly as practical, given the remote nature of Little Exuma Island. The Guest agrees that there will be no refund for malfunction or breakdown of Extras. In the event of a malfunction or breakdown of Extras or any other appliance or feature, including, but not limited to, air conditioners, dishwasher, clothes washer/dryer, outdoor grill, Guest must notify The Agent so repair of the malfunction can be made. The Agent will expedite repair, but no refund of rent will be made.
- Homeowner’s Areas; Locked areas including, but not limited to, Homeowner’s personal storage areas, pool pump shed, Solar Battery room, garage are exempt from Guest usage and are off limits to the Guest and Rental Party. Entry or attempted entry into these areas is cause for immediate eviction and the Guest will be responsible for any damages or missing items and not eligible for a refund of any unused rent.
- Water Quality; The Homeowner is not responsible for water quality. The Property uses water from two sources. The first is City Water which is a water treatment plant in George Town and secondly fresh rainwater from the roof which is stored underground in a 20,000 gallon tank. We supply 2 x 5 gallon bottles of water free of charge which can be access through the two fridges. More drinking water can be bought from a local store (see our help videos).
- Housekeeping All rentals of Ten (10) nights or more will be provided with one (1) or more mid-stay light cleaning, with the quantity dependent upon the length of the stay. Guests may coordinate for additional mid-stay cleanings directly with The Caretaker. Included with the rental rate are all linens, towels, beach towels and an initial starter supply of paper products, dish detergent and cleaning products. The Guest will be expected to purchase additional supplies during The Lease.
- Indemnification and Hold Harmless The Guest and all members of the Rental Party agree to indemnify and hold harmless the Homeowners, The Caretaker, and representatives of The Caretaker, including cost of defence, against and from any and all liability, damages, losses, or claims arising out of this Agreement of the occupancy or use of the Property or its amenities by the Guest, members of the Rental Party, or other invitees. The Homeowner accepts no responsibility for any personal injuries, sicknesses, accidents or death involving or arising from the usage of the Property or amenities, including the house, pool, beach, stairs, garden, decks, or implements (e.g. oven, kitchen equipment, knives, bbq grill, etc). The Property is not child proof. The stairs have no hand rail. The pool is unfenced and could be extremely dangerous to children. The back of The Property is the open to the ocean which contains aquatic life (some of which have big sharp teeth). NEVER swim at night in the ocean. Parents/Guardians of children have full and sole responsibility to monitor and safeguard their children while at the Property. By signing this agreement, it is agreed that the Guest, all members of the Rental Party, and anyone whom they invite to use the Property are expressly assuming the risk of any harm or loss arising from their use of the Property.
- Sale of Property: Should the Property be sold prior to the Term of the Lease, the Buyer will be obligated to honour all existing lease agreements that will end within 180 days of the transfer, as defined by the recording of the deed to the Buyer. The Homeowner will provide written/electronic communication of the sale along with the Buyer’s name and address to all future guests. For existing lease agreements that will end more than 180 days from the transfer, the Buyer may choose to honour the agreements or not honour the agreements. The Buyer will provide written/electronic communication of this decision. If not honouring agreements with leases ending more than 180 days from the transfer date, The Buyer will refund all advanced rents and fees paid by the Guest minus any allowable administrative fees.
The Rental Agreement is governed by the laws of the Commonwealth of The Bahamas.
The Rental Agreement takes effect upon acceptance by the Homeowner.
The parties agree to the terms of the Rental Agreement, as evidenced by the signatures set forth below.

RENTAL RULES
- Personal Safety is your first priority. Little Exuma is remote and as detailed in Item 11 of the rental Agreement, has limited medical facilities. Please use common sense while on the island.
- Smoking is NOT allowed in any indoor, enclosed, or covered structure. Any evidence of smoking inside the Main House or Cottage, including tampering with smoke detectors, will result in the loss of the full Security Deposit. Cigarette butts are not to be discarded in the landscaping as they pose a risk of fire. There is no fire department in Exuma.
- People other than those in the Rental Party set forth above may not stay overnight in the property. Any other person that is part of the Rental Party or is visiting the property is the sole responsibility of the Guest. The Rental Party is not allowed to exceed the Eighteen (18) person occupancy limit agreed to above. If the Rental Party is found to exceed the allowable limit, a charge of $250 per additional person per night will be assessed. Large gatherings (e.g. weddings, parties, guests from other rental homes, etc) are not permitted without written consent from the Homeowner. The house cannot be used for commercial purposes without written consent from the Homeowner.
- Guests should not create excessive noise at a level that disturbs neighbours; Please keep noise down during the quiet hours of 12:00 a.m. – 7:00 a.m.
- When using the A/C, keep doors and windows closed. The A/C systems will freeze up if they are made to work in extreme conditions to keep the house cool with hot air coming in from outside.
- Stains arising from spills on furniture, rugs, or other, may result in a loss of a portion of the Security Deposit.
- No sitting on inside furniture with wet bathing suits.
- Keep the Property and all furnishings in good order.
- Pets are not permitted on the Property under any circumstances. Local dogs and/or cats occasionally roam onto the Property. Please do not feed them.
- Beach towels are permitted to be taken from the house for your use on the beach or around Exuma. They must be returned and kept in the condition you received them in. They must be shaken out outside in order to remove all sand prior to being laundered. Sand will damage the clothes washer and dryer.
- Only use appliances for their intended uses. Kitchen knives are not to be used to open or attempt to open coconuts. This damages the knives and poses a great risk of severe injury to the guest. Brown and many green coconuts are often as hard as a rock.
- Garbage: Garbage must be frequently removed from the house and placed in the trash cans in the garbage shelter, which is located on the driveway. Ensure the bin lids are shut so wildlife does not get in it.
- Pool: Children under the age of 16 must have adult supervision when using the pool. There is no lifeguard and the pool is not childproofed or fenced in. Use at your own risk. The pool caretaker maintains the pool at least twice per week to clean it and check/replenish its chemical levels.
- Water and Septic: Under no circumstances should the Guest or any members of the Rental Party use a hose to fill up the pool to get the infinity edge effect The pool has timers that manage the pumps that create the infinity effect and may be off due to a power outage. Please contact The Caretaker if you feel there is an issue with the pool. A septic system manages the sewage from the house and it is very effective. However, it will clog up if improper material is flushed down the toilets. DO NOT FLUSH anything other than toilet paper.
The undersigned Guest agrees to abide by the rules set forth above for all members of the Rental Party. The Guest further agrees to indemnify and hold harmless the Homeowner, Caretaker, and representatives of the Caretaker, including cost of defence, against and from any and all liability, damages, losses, or claims arising out of this Agreement of the occupancy or use of the Property or its amenities by the Guest, members of the Rental Party, or other invitees. The Homeowner accepts no responsibility for any personal injuries, accidents or death involving or arising from the usage of the Property or amenities, including the house, pool, beach, stairs, garden, decks, or implements (e.g. oven, kitchen equipment, knives, bbq grill, etc).
